CALDA LEGISLATIVE COMMITTEE MISSION

The mission of the Legislative Committee is to provide the CALDA Board of Directors with extensively researched and fully vetted recommendations. We recognize and respect that it is the Board's responsibility to set policy.

We are committed to transparency and inclusivity in our operations. The Legislative Committee will actively engage with all board members, valuing collaboration and fostering mutual trust and respect in our working relationships.

Our focus is on evidence-based communication and advocacy. We will rely on knowledge and facts rather than personal opinions to present CALDA's position on legislative matters. The Advocacy Blog is how we communicate with CALDA stakeholders on legislative matters.

As a politically neutral entity, the Legislative Committee will not endorse or support individual candidates or political parties. Our sole purpose is to advocate for issues and legislation that align with CALDA's goals and interests.

In addition, the Legislative Committee is responsible for developing a comprehensive 5-year strategic legislative strategy. This strategy aims to ensure CALDA's continued independence and strengthen our position as a leading organization in the legal document assistance field.

By embodying these principles and commitments, the Legislative Committee strives to contribute to CALDA's overall mission of advancing the professionalism and competence of legal document assistants in California.

    "ADVOCACY INSPIRED BY KNOWLEDGE" 
    The Advocacy Blog is a biweekly download of CALDA Legislative Strategies and insights into advocating for legislation that will extend the Sunset Date of Business Professional Code, BPC 6400 which regulates LDAs. We will focus on solutions and action plans that stakeholders can implement at the grassroots level to achieve our goal of extending the Sunset Date and preserving the LDA profession.


    MEET THE AUTHOR!

    We are pleased to announce that Assemblymember Phillip "Phil" Chen will be authoring our legislation to extend the sunset date of BPC 6400 for an additional six years, to January 1, 2030.

    Phillip Chen is a member of the California State Assembly.  He represents the 59th State Assembly District, which encompasses portions of Orange and San Bernardino counties. In the California State Assembly, Assemblymember Chen serves as the Vice Chair of the Banking and Finance Committee, and as a member of the Business and Professions, Insurance, Labor and Employment, and Utilities and Energy committees.  Read more...


    WHY CALDA CHOSE ASSEMBLYMEMBER CHEN:

    Phil Chen believes in the mission of CALDA.  He is a successful small business owner and member of the Assembly Business and Professions Committee. In 2019, he introduced AB 1213, sponsored by CALDA, to extend the sunset date to January the 1, 2024. Phil’s knowledge of the legislative history of CALDA, dating back to 2002, makes him the ideal author. CALDA has a excellent working relationship with Phil’s staff who are dedicated to the successful passage of our bill.


    SO WHAT HAPPENS NEXT?

    CALDA BILL TO BE INDRODUCED FEBRUARY 13-17, 2023

    This week, the bill will be assigned a number such as AB xxxx. To accelerate passage of the bill, CALDA’s strategy is to promote a "clean bill." In other words, enhancements to the existing Code which CALDA supports (such as a central LDA database, live scan requirement, and additional MCLE credits) will be deferred to another day. Our survival as a profession hinges on the extension of the current sunset provision, and that will be our primary focus with this legislation.

    THERE IS GOOD NEWS!

    The CALDA Board recently hired Precision Advocacy as our lobbyist to achieve our stated goals. Thanks to Matt Siverling, our former lobbyist, for referring the Precision Advocacy team as your replacement. PA has the experience and the passion to help CALDA promote and educate our elected officials, coalition partners, and advise CALDA on how to build a successful road map to keep LDAs in business. Our first meeting with PA, January 11th ended with the CEO, Amy Jenkins dashing out of her office in Sacramento to pitch two elected officials to author CALDA’s bill. We have the utmost confidence in PA’s ability to deliver the results they were hired to complete. The A-Blog will give CALDA Members a front row seat at meetings with PA to provide transparency and explain why we are recommending a course of action.

    LET"S REVIEW...

    What does it mean for legislation to sunset?

    Sunset law, also known as sunset provision, is a law that automatically terminates an agency, a law, or a government program, that fails to procure legislature approval beyond a fixed period of time. 

    PROBLEM - BPC 6400 SUNSET IS EFFECTIVE JANUARY 1, 2024.

    SOLUTION - CALDA BOARD SELECTS PRECISION ADVOCACY TO IMPLEMENT  STRATEGY TO EXTEND SUNSET DATE OF BPC 6400 AND TO INCORPORATE NEW CONTINUING EDUCATION REQUIREMENTS FOR  LDAS.

    In additional, CALDA plans to add additional oversight and accountability provisions aimed at protecting consumers and preserving the integrity of the expanding LDA profession.


    ROAD MAP TO SUCCESS

    In Partnership with PA the following processes and core competencies will be developed and referred to as our “Road Map to Success” The A-Blog will be reporting and calling for action to implement the Road Map.

    Our top Priority over the next two weeks is to identify the author for our bill. Who we select is a critical first step, and PA has strong relationships with State Senators who will strongly support the CALDA cause. The Advocacy Blog will report our progress in this and other key benchmarks in the legislative process.

    The future of CALDA and the LDA profession hinges on successful implementation of “The Road Map.” Going forward, we will do a deep dive into topics that are mission critical to achieving our goals and objectives. The second issue the A-Blog will focus on is the process of selecting the author of our bill. What are the criteria that we are using to select our bill sponsor?


    SHOUT OUT TO...

    Helen Bellamy, our board member saved the day recently.  She reminded us that LDAs own the PROCESS. At a recent board meeting we were faced with the dilemma that we would have to postpone accepting the proposal from PA until we gave proper notice of the meeting as per our current bylaws. Helen came up with a solution that saved us two weeks by following a process that would allow board members to give their consent to approve the PA proposal by voting to accept or not, without having to call a special board meeting. Thank you, Helen, for always speaking your truth.
